Guns in bars case to be heard Nov. 6, attorney says

A Davidson County judge will start hearing the guns-in-bars lawsuit on
Nov. 6 at 9 a.m., attorney Will Cheek writes on his blog. Cheek is one
of the lawyers for the plaintiffs who are trying to overturn a new
state law. The law allows handgun carry permit holders to take their
firearms into restaurants and bars unless the owners ban them on their
premises.
Who's this Will Cheek guy? For starters, he was one of the Obama "super delegates"...Will Cheek – Obama delegate – A former state party chairman, the
Nashville investor is from one of Nashville's oldest families – the
ones who put the "Cheek" in Cheekwood, the Belle Meade estate that
hosts the Swan Ball and is the home of a museum and botanical garden.
What you may not have known is that Cheek's family also brewed a
helluva a cup of coffee. Cheek's ancestor, Leon T. Cheek, was one of
the two founders of the Nashville Coffee and Manufacturing Company,
makers of Maxwell House coffee.

I got the chance to meet Sen Doug Jackson last Saturday at the 2nd or None event outside of Murfreesboro. I asked him what he thought would happen at this hearing. He said that they actually have a good case and he would give them a 50/50 chance of winning. He said that if that happened that as soon as the legislature came back in Jan. that there would be a bill filed that would fix any problem that this lawsuit pointed out. With the decisive wins last year in both the House and Senate and then the easy override of the veto he was very confident that it would not be a problem to get it back on the books. The fact that we have now been legally carrying guns into restaurants that sell alcohol for over 3 months now with no problems at all it should not see much opposition except for Naiefeh and his followers.
I'm hoping for the lawsuit to get shot down and not have to wait on the legislature again.
Sen. Jackson is a Dem. but he is a class guy. I hope he never does anything to change my opinion of him.

NASHVILLE, Tenn. - Opponents of the controversial guns in bars and restaurant law will take their fight back to court on Friday.
Nine local restaurant owners filed a petition in August asking for a hearing on an injunction to challenge the law. The law, which allows gun carry permit holder to take their weapons into bars and restaurants where alcohol is served, went into effect in July.
However, opponents said the law is unconstitutional and too vague to be enforced. If a court agrees, the law would be put on hold until lawmakers return to session in January.

Chancellor Claudia Bonnyman said the law, enacted earlier this year over the veto of Gov. Phil Bredesen, is "fraught with ambiguity."
She ruled after an hour of arguments in a suit brought by a group of Tennesseans, many of them restaurant owners. The law allowed handgun permit holders to take their weapons into places serving alcohol, providing the establishment makes more than 50 percent of its profits from food.
There was no immediate word from attorneys for the state about an appeal.
The measure took effect July 14. Thirty-seven states had similar legislation at the time.
Many restaurants across the state opted out of the law under a provision allowing them to do so.
The legislation retained an existing ban on consuming alcohol while carrying a handgun.
Nevertheless, critics complained that guns and alcohol in close proximity are a dangerous combination.
Of the roughly 218,000 handgun permit holders in Tennessee, 278 had their permits revoked last year, records showed. Since 2005, state records show nearly 1,200 people have lost their permits.
Rep. Curry Todd, a main sponsor of the measure, said he hadn't seen the ruling but disputed that the law is vague. The Collierville Republican said he will introduce legislation in January to fix any legal problems.
Todd said he will also ask the state attorney general to appeal the ruling.

Isn't Judge Bonneyman a wife to the guy that caused all the stink about Tenn-Care a few years ago...sounds like an activist family affiar to me.

Is this a bill that would allow guns in bars or in establishments that is mainly a restaurant but seves alchohol by the drink too? ie, Applbees,O'Charlies.Texas Roadhouse ect.

I'm not sure but I believe that the vague part has to do with TN not distinguishing what is a bar and what is a restaurant. We have been operating under the law that was passed this summer and even overrode a veto by our Governor. July 14th we started carrying into establishments that serve alcohol and to date there have been no incidents anywhere in the state.
